A Special Note About HIPAA
The Health Insurance Portability and Accountability Act ("HIPAA")
NOTICE OF PRIVACY PRACTICES
This Notice of Privacy Practices (the "Notice") describes the privacy practices and uses of data of LTF Systems, Inc.
LTF Systems, Inc., the owners of BlackTie Medical, wants you to know that nothing is more central to our
operations than maintaining the privacy of all patient information ("Protected Health Information" or "PHI").
Our Pledge Regarding Patient Health Information
We are required by federal and applicable state law, regulations, and other authorities to protect the
privacy of all patient health information (PHI) and to provide you with this Notice. Our staff is required
to protect the confidentiality of all PHI and will disclose PHI only when permitted under federal or state law.
This protection extends to any PHI that is oral, written, or electronic, such as BlackTie Medical implant records,
and information that is transmitted by facsimile, modem, or other electronic device. This Notice describes how we may
use and disclose your PHI.
Uses of Data. Notwithstanding anything to the contrary herein, you (herein referred to as "Customer")
acknowledge that LTF Systems, Inc. may, in the course of its performance of services to Customer hereunder, maintain
and have access to information about Customer and Customer's product usage and order information, sales information,
patient procedure data and other data. LTF Systems will have the right to use all such information (a) for its own
business purposes to the same extent that Customer will have the right to use such information, including without
limitation for troubleshooting, performance analysis, and marketing purposes and (b) to perform statistical
analyses and incorporate into services provided to other BlackTie Medical System users (hospitals and the
vendors that provide products to them) and other third parties; provided, however, that no such information
provided to other BlackTie Medical users shall include any patient identifying information, or any hospital
specific product pricing, physician or staff identifying information, without Customer's approval; and
provided that no such information provided to third parties (non-BlackTie Medical users) shall include any
patient identifying information, hospital identifying information, hospital-specific product pricing or utilization
data, physician or staff identifying information, or other information that could lead to patient, hospital or
staff identification.
Business Associate Agreements (BAA). LTF Systems will routinely review and sign hospital client BAA documents. If you
